I. GENERAL PROVISIONS
For the purposes of these General Terms, the following definitions have been used with the following meaning:
Website https://www.evinarts.com (hereinafter referred to as "Site") was created to promote and sell the works created by the author Venetka Hristova Nitova (hereinafter referred to as the "Author").
Sales are carried out through MаViArt Ltd. (hereinafter referred to as "Company"), which is a commercial company registered in the Commercial Register of the Registry Agency with UIC: 205779917, with its registered office: Botevgrad Municipality; Trudovets village, Detelina №19
"Client" hereinafter is referred to an individual who uses the Company's website.
"Selling price" hereinafter is referred to the final selling price excluding the cost of delivery of the goods, except as otherwise expressly stated.
II. BUY-SELL THROUGH THE WEBSITE OF MAVIART LTD.
The publication of the main features of the painting and its Selling price on the Site by its nature is a public invitation within the meaning of Art. 290, para. 1 of the Commercial Law to make a purchase request in accordance with them.
The company does not guarantee the availability of the ordered works of art. In case of inability to fulfill its obligations, the Company, within 3 (three) working days after receiving the purchase request, notifies the Client - by calling the phone indicated on the online form, telephone number or by sending a message to a specified by the Client e-mail address that the painting is no longer available and about the ability to change the order as desired. In case the payment is made and the Client does not want to change his/her order, the paid amount will be refunded to him/her within 5 (five) working days after receiving feedback from the Client.
III. SHIPPING
As a rule, the orders are delivered within 3-5 days from the moment of sending the request, but a delay of up to 3 (three) working days are possible for Bulgaria. All works of art are insured, which guarantees their integrity during transportation.
The Company is not liable to the Client if the delivery is delayed more than stated due to bad weather conditions, incorrectness of the supplier or other specific situations.
IV. TRANSMISSION OF THE SHIPMENT
The work is delivered to the Client or to a third party designated by him/her, after signing the documents accompanying the shipment, and accepting and acknowledging receipt thereof on behalf of the Client. In the event that the Client is not found within the time limit for delivery to the address specified by him/her or the access and conditions for the delivery of the shipment are not provided within that period, the Company shall be released from its obligation to deliver the painting requested for purchase. The Client can confirm his/her wish to receive the painting after the expiration of the delivery period, in which he/she was not found at the address, to bear all the costs of the reshipment.
The Client shall have the right to refuse to receive the painting requested by him/her for purchase, when the delivered painting does not clearly correspond to the ordered one;
In case of damage during transportation, the Client is obliged to preserve the entire packaging and to contact the logistics company for making a complaint. All works are insured with the purpose of the Client’s convenience. Also, each work comes with an accompanying "Certificate of Authenticity".
A Client who is a consumer within the meaning of the Consumer Protection Act, has the right, without owing compensation or penalty and without giving a reason, to withdraw from the concluded contract for the purchase of goods through the Company's website, by returning the work within 7 (seven) working days from the date of its receipt. In case the Client withdraws from the concluded contract within the period stipulated in the previous sentence, he/she shall send a statement of cancellation and return the painting intact, without any external defects packed in protective cardboards, as shipping costs are borne by the Client. The Client is obliged to keep the painting received by him/her, to ensure the preservation of its intactness and its safety. The Company is obliged to reimburse to the Client in full the amounts paid by him/her not later than 15 working days from the date on which the Company received the work back without any damage.
V. PRICES AND METHODS OF PAYMENT
All prices on the site are in Bulgarian levs or euros including shipping costs, except for orders under 300 levs or 150 euros for the territory of the Republic of Bulgaria.
Abroad the Client shalll bear all the costs of delivery.
The Price and shipping costs can be paid in any of the following ways:
a) on delivery - in cash by the Client or by a third party on behalf of the Client;
b) by bank transfer to a bank account of MaViArt Ltd.;
c) through PayPal.
By selecting the payment method provided for in points (b) and (c) above, the Client - Consumer under the Consumer Protection Act agrees to make an advance payment of the paintings within the meaning of Art. 53, para 1 of the Law.
VI "IN ORDER"
For all works made “in order”, the following conditions are met:
a) all delivery costs are at the expense of the Company, regardless of the Price of the work.
b) The Price of the order and the time for its execution vary depending on its size and complexity.
c) all works are paid only and exclusively by cash on delivery.
VII. OTHERS
The Company takes care that the information on the Site is always kept correct and up-to-date, but does not guarantee its accuracy and completeness.
For issues not settled by these General Terms and Conditions, the provisions of the effective legislation of the Republic of Bulgaria shall apply.
The Client is solely responsible for sharing confidential information with third parties.
The Company assumes no liability whatsoever in the event that the Client is misled by third parties who represent themselves as representing the interests of the Company.
The Client undertakes to inform the Company. about the presence of such attempts, using the available contact forms.
The Company does not distribute unsolicited commercial communications within the meaning of the Electronic Commerce Act.
Contacts made by MaViArt Ltd. through means of remote communication (for example e-mail) contain complete and consistent information about the sender and links to him/her at the time of sending.
VII. FINAL PROVISIONS
The Company reserves the right to make changes to these General Terms and Conditions and any changes to the Site, its structure and the Services, including changes that would affect the
Site and/or its content without prior notice to the Clients.
The Company is not responsible for any errors that may occur on the Site for any reason, including those caused by changes, settings, others that are not made by the site administrator.
The Company reserves the right to publish advertisement banners of any kind and/or links on any part of the Site, in accordance with the applicable legislation.
All paintings and products presented on the Site owned by MaViArt Ltd., are copyrighted and cannot be copied, reproduced, or used for advertising or other purposes without the express, written permission of their author.
